Please read these terms carefully before using Donkomi

Agreement to Terms

Welcome to Donkomi! These Terms and Conditions ("Terms") govern your access to and use of our marketplace platform, including our website, mobile applications, and related services (collectively, the "Platform").

By accessing or using Donkomi, you agree to be bound by these Terms and our Privacy Policy. If you don't agree with any part of these Terms, you may not use our Platform.

Important: These Terms include a binding arbitration clause and class action waiver. Please read Section 10 carefully.

Account Terms

Account Creation

You must be at least 18 years old to create an account. You're responsible for maintaining the confidentiality of your account credentials and all activities under your account. We reserve the right to refuse service or terminate accounts that violate these terms.

Account Types

Donkomi offers two account types: Customer and Vendor. Customers can browse and purchase products, while Vendors can list and sell products subject to approval. Switching between account types requires admin approval.

Account Security

You must notify us immediately of any unauthorized use of your account. We're not liable for losses caused by unauthorized access unless it results from our negligence. Enable two-factor authentication for enhanced security.

Purchases & Payments

Product Listings

All product listings, descriptions, and prices are provided by individual vendors. While we strive for accuracy, we don't guarantee that all product information is complete or error-free. Vendors are responsible for accurate product representation.

Pricing & Fees

Prices are displayed in Ghana Cedis (GHS) and include applicable service fees. Service fees range from GHS 1.00 to GHS 4.00 depending on order value. Prices are subject to change, but orders placed are honored at the price displayed at checkout.

Payment Processing

We use third-party payment processors (Paystack, Hubtel) for secure transactions. By making a purchase, you authorize us to charge your selected payment method. All sales are final once order is shipped unless covered by our return policy.

Order Cancellation

You may cancel orders in 'Pending' or 'Processing' status. Orders that have been shipped cannot be cancelled but may be returned per our return policy. Refunds are processed within 5-7 business days to your original payment method.

Vendor Obligations

Vendor Approval

Vendor accounts require admin approval before products can be listed. We reserve the right to deny or revoke vendor status at our discretion. Vendors must provide accurate business information and banking details for payouts.

Product Listings

Vendors must accurately describe products, set fair prices, and maintain adequate inventory. Prohibited items include counterfeit goods, illegal substances, weapons, stolen property, and items that violate intellectual property rights.

Order Fulfillment

Vendors must process orders within 1-2 business days and ship within stated timeframes. Failure to fulfill orders may result in account suspension. Vendors are responsible for product quality and must honor return requests per platform policy.

Vendor Payments

Earnings are added to your wallet upon order delivery confirmation. Minimum withdrawal is GHS 50. We deduct applicable fees (platform fees, withdrawal fees) from payouts. Payments are processed within 24-48 hours of withdrawal request.

Returns & Refunds

Return Eligibility

Most items can be returned within 7 days of delivery if unused and in original packaging. Food items, personalized products, and intimate items are not eligible for return. Contact the vendor through our messaging system to initiate returns.

Refund Process

Refunds are issued after we receive and verify returned items. Processing takes 5-7 business days. Refunds are credited to your original payment method. Shipping fees are non-refundable unless the product was defective or incorrectly sent.

Damaged or Defective Items

Report damaged or defective items within 48 hours of delivery with photos. We'll arrange for return shipping at no cost and issue a full refund or replacement. The vendor bears responsibility for shipping defective products.

Prohibited Activities

User Conduct

You may not use Donkomi to engage in fraudulent activities, harassment, spam, or any illegal activities. Don't attempt to manipulate reviews, prices, or search rankings. Violation may result in immediate account termination and legal action.

Intellectual Property

Don't list products that infringe on copyrights, trademarks, or patents. Respect others' intellectual property rights. We respond to valid DMCA takedown notices and may terminate repeat infringers' accounts.

System Integrity

Don't attempt to hack, disrupt, or abuse our platform. Don't use automated systems (bots, scrapers) without permission. Don't circumvent security features or access controls. Such activities may result in legal prosecution.

Limitation of Liability

To the maximum extent permitted by law, Donkomi and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

Our total liability for any claims arising from your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim, or GHS 100, whichever is greater.

Dispute Resolution

Informal Resolution

Before filing a claim, you agree to try to resolve disputes informally by contacting us at [email protected]. We'll attempt to resolve the dispute within 30 days.

Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in Ghana under Ghanaian Arbitration Act. You waive the right to participate in class actions or class arbitrations.

Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or misuse of the Platform without first engaging in arbitration.

Changes to Terms

We may update these Terms from time to time. We'll notify you of material changes via email or prominent notice on our Platform. Continued use after changes constitutes acceptance of the updated Terms.

Your use of Donkomi after the effective date of revised Terms indicates your acceptance. If you don't agree with changes, you must stop using the Platform.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana, without regard to conflict of law principles. Any legal action must be brought in the courts of Accra, Ghana.
